Terms of Service

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("User") and Ryncast ("we", "us", "our"). By accessing or using the Ryncast platform at stage-web.ryncast.com or our marketing site at ryncast.com, you acknowledge that you have read, understood, and agree to these Terms.

If you do not agree to these Terms, you may not access or use Ryncast.

2. Eligibility

You must be at least 16 years old to use Ryncast. By using our platform, you represent and warrant that you meet this requirement. If you are using Ryncast on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration and Security

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and complete registration information.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.
• You may not share your account credentials with others or allow others to access your account.

4. Acceptable Use

When using Ryncast, you agree not to:

• Upload, share, or publish content that is illegal, defamatory, obscene, or violates any third party's intellectual property rights.
• Use Ryncast to distribute spam, malware, or other harmful content.
• Attempt to access accounts, systems, or data that you are not authorized to access.
• Reverse engineer, decompile, or attempt to extract the source code of the platform.
• Use automated bots, scrapers, or other tools to access or extract data from the platform without our express written permission.
• Engage in any conduct that interferes with or disrupts the platform or servers.
• Circumvent or attempt to circumvent any platform security or access controls.

5. Content Ownership and Licenses

5.1 Your Content

You retain full ownership of all content you upload to Ryncast (videos, thumbnails, descriptions, etc.). You grant us a limited, non-exclusive, royalty-free license to store, process, transcode, and deliver your content solely as necessary to provide the service.

5.2 Content Responsibility

You are solely responsible for all content you upload or publish through Ryncast. You warrant that:

• You own or have the necessary rights to use and publish the content.
• The content does not infringe any third-party intellectual property rights.
• The content complies with all applicable laws and regulations.

5.3 Ryncast Intellectual Property

All intellectual property rights in and to the Ryncast platform, including its code, design, branding, and documentation, are and remain the exclusive property of Ryncast. These Terms do not grant you any rights to our intellectual property.

6. Third-Party Integrations

Ryncast integrates with third-party services including YouTube (Google), Mux, Cloudflare, and Clerk. Your use of these services is governed by their respective terms of service. We are not responsible for the practices of these third parties.

When you connect your YouTube account, you authorize Ryncast to publish content on your behalf based on your explicit instructions. You can revoke this access at any time from your Google account settings.

7. Fees and Payment

Ryncast offers a free Starter plan. Paid plans are also available. By subscribing to a paid plan:

• You authorize us to charge your payment method on a recurring basis.
• You may cancel at any time. Your access continues until the end of the current billing period.
• All fees are non-refundable except as required by applicable law or as expressly stated in our refund policy.
• We reserve the right to change our pricing with 30 days' notice to active subscribers.

8. Termination

We may suspend or terminate your account at any time, with or without notice, if:

• You violate these Terms or our Acceptable Use Policy.
• We detect fraudulent, abusive, or illegal activity associated with your account.
• Your payment fails and is not resolved within a reasonable time.

You may delete your account at any time from your account settings. Upon deletion, your data will be removed per our Privacy Policy.

9. Disclaimers and Limitation of Liability

RYNCAST IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Ryncast's total liability to you for any claims arising from these Terms or your use of the platform shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

10. Indemnification

You agree to indemnify and hold harmless Ryncast and its affiliates, officers, agents, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your content, or your violation of these Terms.

11. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

12. Changes to These Terms

We reserve the right to update these Terms at any time. We will provide at least 14 days' advance notice for material changes via email or in-app notification. Your continued use of Ryncast after the effective date of any changes constitutes acceptance of the new Terms.
